In latest unstable this is exported to non-GPL modules, presumably to fix the
same sorts of problems as you saw.  The change probably happened a while ago. 
Closing as fixed.  If this is still an issue on your platform, you could just
apply your patch as a stopgap measure until you upgrade to a Xen where it's
already fully exported.
